Preamble

Welcome to Sapataria do Carmo and to the Terms and Conditions that define the rules and regulations for using our website: www.sapatariadocarmo.com – owned by the company Paulo da Cruz Lda.

The sales conditions are agreed between PAULO DA CRUZ Lda., with registered office at Largo do Carmo, 26, 1200-092 Lisbon, NIPC 502520710 and hereinafter referred to as SAPATARIA DO CARMO or @sapatariadocarmo, and the individuals wishing to make purchases through the website: https://sapatariadocarmo.com/, hereinafter referred to as "User":

The parties agree that purchases made through the website: https://sapatariadocarmo.com/ will be exclusively governed by this agreement.

Article 1 – Purpose

The purpose of these general conditions of sale is to provide and define all necessary information to the User regarding orders, payments, and deliveries made on the website: www.sapatariadocarmo.com.

These conditions regulate all necessary steps to place an order and ensure its follow-up between the two Contracting Parties.

Article 2 – Products

Although products are characterized with the utmost care and are photographed and/or captured in video using professional means, the aim is to convey an image as close to reality as possible. In some specific cases, there may be tonal differences. It should be noted that computer monitors vary, however, we can guarantee that the pair of shoes you receive will be very close to the one photographed.

The items/products are handmade, not mass-produced, and may show variations in texture, color, and finish. This is not a defect, but rather a characteristic of the uniqueness of the product presented.

Article 3 – Order

The user places their order by adding the product(s) they wish to order to their shopping cart.

To submit their order, the User must:

  1. Register on the website www.sapatariadocarmo.com by filling in the requested fields.
  2. Log in (providing a combination of email and password chosen by the User at the time of registration).
  3. After registering as a customer, the User can access their personal online account by logging in.

On the website https://sapatariadocarmo.com/, you can also make purchases without logging in, by completing the information and choosing the options provided throughout the ordering process (delivery address and billing address, shipping method, payment method, as well as name and tax identification number, if you wish them to appear on the invoice).

The User's final order confirmation implies full and complete acceptance of the described items and their respective prices, as well as the General Terms and Conditions of Sale – the only ones applicable to the contract thus concluded.

The information on the invoice is the sole responsibility of the User. The invoice, once issued, cannot be reissued with changes.

The order is considered complete upon payment.

Upon accessing their personal online account, the User is subject to these general conditions, as well as the legal and regulatory norms that govern its operation and use of the website.

Article 4 – Customize Shoes

If you wish to make any changes to our model(s), you should contact us via email geral@sapatariadocarmo.com or through the form in the "Customize Shoes" menu.

After confirmation with the manufacturer, we will provide all details in response, such as: manufacturing feasibility, production time, price change, and any other aspect that may be necessary as a result of the requested change.

The order will be placed after approval by the User and respective payment of 50% non-refundable amount.

Article 5 – Stock Availability

Sapataria do Carmo undertakes to send orders received online according to available stock.

The availability of our products is subject to change.

If the selected shoes are not in stock, we will contact the User to inform them about the necessary manufacturing time. Generally, the manufacturing period is around 3-4 weeks.

@sapatariadocarmo reserves the right to update or modify information, articles, prices, promotions, and commercial conditions at any time.

Article 6 – Prices

All prices for @sapatariadocarmo products indicated on the website https://sapatariadocarmo.com/ include Value Added Tax (VAT), at the current rate of 23%.

If any error is found in the price of the requested products, both @sapatariadocarmo and the User may, at any time, until the products are dispatched, cancel the order request.

Prices are always subject to final validation and in accordance with the invoice issued for the purchase.

Article 7 – Promotions and Sales

At @sapatariadocarmo you may find different promotions in the form of percentage discounts on the retail price or in the form of discount codes, which can be percentage-based or value-based. Discount codes may also be related to national or international shipping costs.

All promotions have a defined validity period and comply with commercial practices with price reductions, regulated by Decree-Law No. 70/2007, of March 26 – “Law on Sales, Promotions, and Liquidations” – with the most recent changes introduced by Decree-Law No. 109/2019, of August 14, rectified by Rectification Statement No. 38/2019, of August 21.

To benefit from the reduced price of items presented on the website https://sapatariadocarmo.com/, the order must be finalized and paid for by the User until:

  • the end of the announced promotional period (or campaign)
  • the limit of available stock, whichever occurs first.

Saving a product in the "shopping cart" or "favorites" does not guarantee its availability, price, or applicable discount.

Article 8 – Payment

On the website: https://sapatariadocarmo.com/, payment for respective orders can be made through the payment management entity, RedUnicre — Instituição Financeira de Crédito S.A. and through PayPal Holdings, Inc.

The privacy and security of documents and information transmitted over the Internet are guaranteed by the aforementioned and identified contractual partners.

The payment methods available on the @sapatariadocarmo website are:

  • Credit Card – (Visa; Maestro; Mastercard)
  • Multibanco Reference
  • MB Way
  • PayPal
  • Apple Pay and Google Pay
  • Bank Transfer – upon request via email: geral@sapatariadocarmo.com

In the case of credit card payments, the debit will be made to the User after confirmation of the items' dispatch. If the ordered product(s) are out of stock, the corresponding amount will be released from the User's card.

Article 9 – Delivery

Orders are dispatched within 24-48 hours after payment confirmation. Any cancellation or modification of an order should preferably be made before dispatch.

@sapatariadocarmo reserves the right to have a variable national and international shipping cost policy throughout the year.

@sapatariadocarmo undertakes that the shipping price policy practiced within a certain period will be explicitly and visibly presented on the website www.sapatariadocarmo.com.

For example, Sapataria do Carmo may organize advertising campaigns with Free Shipping for an unlimited or limited period; free shipping campaigns above a certain value; with an unlimited or limited period. It may also offer discount codes.

9.1 – National Shipments:

Currently, Sapataria do Carmo uses the services of the company MRW Entregas www.mrw.pt with delivery until 7:00 PM on the next business day in mainland Portugal and Spain.

For the Autonomous Region of the Azores and the Autonomous Region of Madeira, deliveries will be made through the national service CTT – registered mail or CTT Expresso, with a delivery time of 1-4 business days in most cases.

* For these destinations, in certain cases, the delivery time may not be met by our contractual partner for reasons beyond the control of Sapataria do Carmo.

9.2 – International Shipments:

Currently, @sapatariadocarmo uses the services of UPS and DHL Express internationally, except for Spain (as per article 9.1).

In Europe, deliveries are made within 1-2 business days.

For the USA and Canada, our deliveries are made in 2-3 business days.

For the Rest of the World, our deliveries are made in 5-6 business days.

Partner companies UPS and DHL Express reserve the right not to deliver to PO boxes. There are situations such as "remote areas" and "customs clearance process" that may delay the aforementioned intervals and lead to some price changes to be confirmed.

Article 10 – International Pricing Policy

Todos os preços dos produtos @sapatariadocarmo indicados no sítio https://www.sapatariadocarmo.com incluem Imposto sobre o Valor Acrescentado (IVA), à taxa atual de 23%.

Para os países NON – U.E : ATENÇÃO, tenha em consideração que ao receber a sua encomenda poderá pagar taxas correspondentes ao país de destino.
